Property Tax, Titling and Agreements for Same-Sex and Unmarried Couples

The past year has seen dramatic changes not only in the federal recognition of same-sex marriage, but also in rules relating to California property taxes for co-owners who are not married to each other and are not domestic partners. Both of these changes can have dramatic and very expensive consequences for co-owners of property, whether married, unmarried, domestic partnered, or not. Many of the changes can be addressed simply with property agreements, re-deeding of property, and other estate planning tools.
