LGBT Estate Planning and Tax Issues, 18 months post-DOMA repeal

The historic decision in United States v. Windsor in June 2013, while heralded the repeal of DOMA Section 3, has profoundly changed the legal landscape for same-sex couples throughout California and the United States. While the federal recognition of same-sex marriage has in many ways made estate planning and tax planning easier, in other ways, the issues are still divergent and more complicated than for opposite-sex married couples.

Program topics include:

Should we get married, or state domestic partnered?
How will marriage or domestic partnership affects our state and federal taxes?
What estate planning issues do we need to address if we do get married or domestic partnered?
Is it time to set up a joint trust, or change our property titling to community property?
What special planning is needed if we choose not to marry or register as state domestic partners?
